PixMaker User Agreement

Terms of use for the PixMaker product, app and services

1. Introduction

This User Agreement governs your use of PixMaker products, including the LED board, mobile application, digital content, design tools, AI features, website features, support services, and related services.

By using PixMaker, creating an account, connecting the product to the app, or accessing our services, you agree to this User Agreement.

PixMaker is a guided creation system that combines hardware and software to help users create fuse bead designs faster, more accurately, and with less manual counting.

2. Company Information

PixMaker is operated by Pixply Ltd, a company registered in England and Wales under company number 16040467, with its registered office at Office One, 1 Coldbath Square, Farringdon, London, United Kingdom, EC1R 5HL.

3. Eligibility

To create an account or use PixMaker independently, you must be at least 16 years old, or at least 13 years old if you are in the United States. Where the law that applies to you sets a different minimum age for digital consent, that age applies instead.

A child below the relevant age may use the physical product only under the direct supervision of a responsible adult, and must not create an account or submit personal data through the app.

If you allow a child to use PixMaker, you are responsible for supervising safe and appropriate use of the product, app, designs, and related features, and you accept this User Agreement on their behalf.

4. Product Use

You agree to use PixMaker only for its intended purpose, which is creating bead designs using the guided LED system and related app features.

You must not:

  • Modify, damage, open, tamper with, or reverse engineer the hardware, firmware, software, app, or services, except where this restriction is prohibited by law;

  • Use PixMaker for illegal, unsafe, harmful, abusive, or unauthorized purposes;

  • Interfere with the app, firmware, Bluetooth connection, servers, payment systems, security systems, or related services;

  • Attempt to copy, extract, resell, reproduce, or misuse PixMaker software, content, technology, or design libraries; or

  • Use PixMaker in a way that may damage the product, another device, another person’s property, or another person’s rights.

5. Account and App Usage

Some features may require an account.

You are responsible for keeping your login details secure and for all activity under your account.

You must provide accurate account information and keep it updated where required.

We handle your personal data in accordance with our Privacy Policy, which forms part of your use of PixMaker. Please read it at pixply.io/privacy.

We may update, improve, modify, replace, limit, or remove app features from time to time. We will aim to maintain the main functionality of PixMaker, but some features may change as the product develops.

Some app features may require internet access, Bluetooth access, device permissions, app updates, operating system compatibility, or third party services.

6. App Availability and Compatibility

PixMaker app availability may depend on your mobile device, operating system, region, app store rules, internet connection, Bluetooth performance, and other technical conditions.

We do not guarantee that every feature will work on every device or operating system version.

You are responsible for using a compatible device and keeping your app and operating system reasonably updated.

7. Image Conversion Tools

PixMaker may allow users to upload or import images and convert them into bead patterns or pixel based designs.

You are responsible for any image, photo, artwork, logo, character, brand, pattern, or other content that you upload, import, convert, edit, save, share, publish, or use through PixMaker.

You must only upload or use content that you own, have permission to use, or are legally allowed to use.

PixMaker is not responsible if you upload, convert, use, publish, sell, or share copyrighted images, protected characters, brand logos, celebrity images, artwork, or other third party content without permission.

Image conversion results may vary depending on image quality, color, resolution, bead type, design size, app settings, and user adjustments.

You are responsible for reviewing the converted design before using it, especially for public, commercial, resale, advertising, or social media purposes.

8. AI Features

PixMaker may include AI features, such as text based pixel art generation, creative assistance, or design suggestions. These features may be experimental, limited, or in testing.

AI results may vary and may not always be accurate, complete, suitable, original, or error free. You are responsible for reviewing any AI output before using it.

AI features may require internet access, account access, or external processing services.

We may modify, limit, suspend, or discontinue AI features for technical, legal, commercial, supplier, safety, or platform related reasons.

If paid AI features, premium features, in-app purchases, or subscriptions are offered in the future, the price, billing method, renewal terms, cancellation terms, and any usage limits will be shown before purchase.

9. User Content and Third Party Rights

You are responsible for all content you upload, import, create, convert, generate, edit, save, share, publish, sell, or otherwise use through PixMaker (“user content”).

You must not use PixMaker to copy, convert, generate, reproduce, share, publish, sell, or commercially exploit content that infringes copyright, trademarks, design rights, image rights, privacy rights, publicity rights, personality rights, moral rights, or any other third party rights.

PixMaker does not claim ownership of your original user content. However, by using PixMaker, you give PixMaker and Pixply Ltd a limited permission to process, display, store, convert, generate, transmit, and technically handle your content as needed to provide the product, app, design conversion, AI features, storage, support, safety, and related services.

Designs you create, convert, or generate through PixMaker may unintentionally resemble existing works, brands, characters, patterns, photos, or protected content. You are responsible for checking whether your content and outputs are suitable and lawful to use.

We may remove, block, restrict, or delete content if we believe it may violate any law, third party rights, platform rules, this User Agreement, or our policies.

To the maximum extent permitted by applicable law, PixMaker and Pixply Ltd are not responsible for claims, losses, damages, disputes, or legal issues caused by user uploaded, user imported, user generated, user converted, user published, user sold, or user shared content.

10. Digital Content and Designs

PixMaker may provide design libraries, tutorials, app content, generated designs, converted designs, user generated designs, templates, instructions, and other digital content.

Unless clearly stated otherwise, PixMaker designs and digital content are provided for personal and non-commercial use only.

You may not resell, redistribute, copy, upload, publish, license, or commercially exploit PixMaker designs, tutorials, app content, or design libraries without written permission.

You must not remove copyright notices, brand notices, watermarks, ownership labels, or other rights information from PixMaker content.

11. Intellectual Property

All PixMaker technology, including the hardware design, software, firmware, app interface, user experience, design libraries, tutorials, product name, logos, brand assets, images, text, systems, and related content, is owned by PixMaker, Pixply Ltd, or its licensors.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use PixMaker and its app for normal product use.

This User Agreement does not transfer ownership of any intellectual property to you.

12. Feedback and Suggestions

If you send us ideas, feedback, suggestions, feature requests, comments, designs, or improvement proposals, you agree that we may use them to improve PixMaker without owing payment, credit, ownership rights, or compensation, unless we separately agree in writing.

You should not send confidential ideas unless a separate written agreement is in place.

13. Safety and Responsibility

You agree to use PixMaker safely and follow all instructions provided with the product, app, packaging, website, or support materials.

Important safety rules:

  • Use only recommended power sources;

  • Keep the product away from water, liquids, excessive heat, and unsafe environments;

  • Do not use damaged cables, adapters, boards, or accessories;

  • Do not bend, cut, puncture, crush, or modify the board;

  • Children must be supervised by an adult;

  • Follow all bead crafting and ironing instructions carefully;

  • Do not leave the product unattended when heat, electricity, children, or pets are involved;

  • Allow the product to cool where needed before handling or storing; and

  • Stop using the product if you notice overheating, unusual smell, smoke, damage, exposed wires, or abnormal behavior.

We are not responsible for damage, injury, product failure, or loss caused by misuse, unsafe handling, ignored instructions, unauthorized modification, unsuitable power sources, third party accessories, or use outside the intended purpose.

14. Ironing and Craft Use

PixMaker may allow users to iron bead designs directly on the board if this feature is supported by the specific product version and instructions.

You must follow the official ironing instructions carefully.

Ironing performance may vary depending on bead type, iron temperature, ironing time, pressure, paper or protective layer, user handling, and environmental conditions.

You are responsible for avoiding overheating, burning, melting, surface damage, personal injury, or damage to nearby objects.

Children must not iron without adult supervision.

15. Hardware and Performance

PixMaker is designed to improve speed, guidance, and accuracy in bead crafting, but results may vary depending on bead type, bead color, design complexity, lighting conditions, user handling, app compatibility, Bluetooth performance, device performance, and software version.

Minor differences in color, brightness, materials, packaging, app interface, or product appearance may occur between product batches, images, prototypes, and final production units, provided that the main product functionality remains reasonably consistent with the product description.

PixMaker is provided subject to applicable consumer rights and reasonable product quality standards.

Nothing in this User Agreement removes rights that cannot legally be removed under the laws that apply to your purchase.

16. Third Party Services

PixMaker may rely on third party services, including app stores, AI providers, cloud services, payment providers, delivery providers, mobile operating systems, Bluetooth systems, analytics tools, hosting providers, and communication platforms.

We are not responsible for interruptions, restrictions, delays, price changes, policy changes, account restrictions, technical issues, or service failures caused by third party services outside our reasonable control.

17. Updates

We may provide software, firmware, app, security, content, feature, or compatibility updates.

Some updates may be required for continued use of certain features.

Failure to install important updates may affect performance, security, compatibility, or access to features.

We may update the app or product features to improve performance, fix bugs, improve safety, comply with legal requirements, or support new functionality.

18. Purchases, Preorders, Deposits, and Payments

Purchases, preorders, deposits, remaining balance payments, taxes, shipping fees, and delivery estimates are governed by the information shown at checkout and in the applicable purchase terms at the time of order.

If a deposit option is offered, the remaining balance must be paid before dispatch according to the payment instructions provided.

Delivery dates are estimates unless clearly stated otherwise.

We may contact you by email with important order, payment, production, shipping, app, safety, or support updates.

19. Returns, Refunds, Cancellation, Warranty, and Support

Support is provided via: support@pixply.io.

Returns, refunds, cancellations, repairs, replacements, and warranty support are handled according to the policy shown at the time of purchase and any mandatory consumer protection laws that apply in your region.

If you are a consumer in the UK or EU buying physical goods online, you may have a statutory right to cancel within 14 days of receiving the goods, subject to legal exceptions. Where this right applies, the product must be returned unused, undamaged, and in its original condition and packaging, unless applicable law provides otherwise.

Digital content, app features, AI features, downloadable content, generated designs, and other digital services may not be refundable once access, download, generation, processing, or use has started, except where required by applicable law.

Consumers outside the UK and EU, including in the US and Japan, have the rights provided by their applicable local law.

Nothing in this User Agreement removes your statutory consumer rights.

Refunds, repairs, or replacements may be refused where damage is caused by misuse, unauthorized modification, ignored instructions, unsuitable power supply, accidental damage, normal wear, or use outside the intended purpose, unless applicable law requires otherwise.

20. Prohibited Use

You must not use PixMaker, the app, AI features, image conversion tools, or related services to:

  • Violate any law or regulation;

  • Infringe another person’s intellectual property or privacy rights;

  • Create, upload, convert, generate, publish, or sell illegal or harmful content;

  • Harass, abuse, impersonate, threaten, or deceive others;

  • Circumvent security, access controls, usage limits, payment systems, or technical restrictions;

  • Scrape, copy, extract, or reproduce PixMaker content, software, databases, or systems; or

  • Use PixMaker in a way that harms the product, app, services, company, users, or third parties.

21. Suspension or Termination

We may suspend, restrict, or terminate access to accounts, app features, AI features, content, or services if you violate this User Agreement, misuse the system, infringe rights, attempt unauthorized access, fail to make required payments, or use PixMaker in a harmful, illegal, or unsafe way.

Where reasonable, we may provide notice. However, we may act immediately where needed for safety, security, legal, payment, rights protection, or platform compliance reasons.

22. Disclaimer

PixMaker is intended as a creative craft support tool.

PixMaker does not guarantee perfect designs, perfect bead placement, perfect AI outputs, exact color matching, uninterrupted app access, or compatibility with every device, bead type, image, operating system, or third party service.

Product images, videos, app screens, examples, and marketing materials may show examples, prototypes, simulations, or representative use cases. The final product and app may vary within reasonable limits.

23. Limitation of Liability

Nothing in this User Agreement limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where such liability cannot legally be limited.

Subject to the paragraph above, and to the maximum extent permitted by applicable law, PixMaker, Pixply Ltd, and related parties are not liable for indirect losses, loss of data, loss of content, loss of profit, business interruption, loss of opportunity, emotional distress, reputational damage, or damage caused by misuse of the product.

Subject to the first paragraph above, and to the maximum extent permitted by applicable law, our total liability for claims relating to PixMaker is limited to the amount paid for the product or service giving rise to the claim. If you are a consumer, you have legal rights that this section does not affect.

24. Indemnity

To the maximum extent permitted by applicable law, if you use PixMaker other than as a consumer you agree to be responsible for claims, losses, damages, costs, expenses, or disputes arising from:

  • Your misuse of PixMaker;

  • Your violation of this User Agreement;

  • Your violation of any law or regulation;

  • Your infringement of third party rights;

  • Your uploaded, imported, generated, converted, published, sold, or shared content; or

  • Your commercial use of content created through PixMaker without proper rights or permissions.

25. Changes to This Agreement

We may update this User Agreement from time to time.

If changes are material, we will give reasonable notice through the app, email, website, account notice, or another reasonable method before they take effect.

Continued use of PixMaker after changes become effective means you accept the updated User Agreement. If you do not accept a material change, you may stop using PixMaker and close your account, and you keep any statutory rights and any cancellation or refund rights described in section 19.

26. Governing Law

This User Agreement is governed by the laws of England and Wales, unless mandatory consumer protection laws in your country or region provide otherwise.

If you are a consumer, you may also have mandatory rights in your country or region that continue to apply regardless of this clause.
