Pixply App Terms and Conditions ("Terms") form a legally binding agreement between you ("user") and Pixply Ltd, governing your use of the Pixply mobile application ("App") and your interaction with the Pixply digital game board and accessories ("Device").
By installing, accessing, or using the App, you agree to these Terms and to the Pixply App Privacy Policy.
Nothing in these Terms reduces your mandatory consumer rights.
1. Purpose and Scope
The App enables Bluetooth communication with the Pixply Device, interaction with digital game content, and supporting functions including firmware updates, content creation, and device configuration.
These Terms apply only to the App. Terms for purchasing Pixply Devices or using our website may differ.
2. App Requirements and Permissions
To function correctly, the App requires:

Bluetooth access, for device pairing and communication.

Local storage, for saving settings and optional PixStudio designs.

Network access, for updates, activation, and support requests.
Optional permissions (such as notifications) can be managed in your device settings.
3. Freemium and Paid Features
The App currently includes free features. Pixply may introduce optional paid or premium features in the future. Access to certain features may change over time, and Pixply may modify, limit, or discontinue free features without prior notice. Any paid features will always require your explicit consent.
4. Updates and Firmware
The App or Device may receive updates to improve performance, fix issues, or add functionality.
By using the App, you agree that:

Updates may install automatically or require manual approval.

Some functions may not work unless the latest update is installed.

Features may be added, modified, or discontinued at any time.
5. User Content and Responsibilities
The App may allow creation or customisation of layouts or configurations ("User Content"). You agree that:

You retain ownership of your User Content.

User Content is stored locally and is not uploaded unless you intentionally share it (for example, in a support request).

You are responsible for ensuring your content does not violate applicable laws or infringe third-party rights.
6. Acceptable Use
You agree not to:

Interfere with or disrupt the App or Device.

Reverse-engineer, modify, or create derivative works of the App or firmware except where permitted by law.

Use the App in unlawful, harmful, or offensive ways.

Attempt unauthorised access to Pixply systems or services.
7. Intellectual Property
All technology, firmware, designs, interfaces, trademarks, and related materials are owned by Pixply Ltd or its licensors.
You are granted a limited, revocable, non-exclusive licence to use the App solely to operate your Pixply Device.
You may not copy, distribute, or commercially exploit the App without written approval from Pixply.
8. Data and Privacy
The App collects only limited technical and diagnostic information required for functionality and security.
All data processing follows the Pixply App Privacy Policy, which you agree to by using the App.
Pixply does not use App data for advertising or behavioural tracking.
9. Limitation of Liability
To the maximum extent permitted by law, Pixply Ltd is not liable for:

Loss of data.

Indirect, incidental, or consequential damages.

Losses resulting from misuse of the App or Device.
Nothing in these Terms excludes liability for:

Fraud.

Death or personal injury caused by our negligence.

Mandatory consumer protections under applicable law.
10. Termination
You may stop using the App at any time.
Pixply may suspend or terminate access to the App if:

You violate these Terms.

It is required for legal, safety, or security reasons.

The App or certain features are discontinued.
Upon termination, the licence granted to you ends automatically.
11. Governing Law
These Terms are governed by the laws of England and Wales.
If you are an EU consumer, you may rely on mandatory consumer protection laws in your own country.
12. Changes to These Terms
We may update these Terms periodically. If updates materially affect your rights, we will notify you within the App or via our website.
Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
